Terms of Service

1. The Service

Hometown Coloring Book produces locally distributed print coloring books that combine coloring pages with sponsorships from neighborhood businesses. The Service includes the website, sponsorship purchases, creative production (including AI-assisted coloring page generation), proofs, printing coordination, and distribution.

2. Eligibility and accounts

• You must be at least 18 years old to create an account or buy a sponsorship.
• You agree to provide accurate, current, and complete information and to keep it updated.
• You are responsible for activity under your account and for keeping your credentials secure. Tell us immediately if you suspect unauthorized use.

3. Sponsorships and orders

• Reservations and pricing. Sponsorship slots may be temporarily reserved during checkout and released if not paid for within the reservation window. Prices are shown at checkout and may change between editions.
• Payment. Payments are processed by Stripe. You authorize us (and Stripe) to charge the payment method you provide for the total shown at checkout, including any applicable taxes.
• Acceptance. An order is confirmed only when payment succeeds and you receive a confirmation. We may decline or cancel any order at our discretion (for example, pricing errors, suspected fraud, or content that violates these Terms), in which case we will refund any amount charged.
• Production timeline. Coloring books are produced on an edition schedule. Estimated production and delivery dates are not guarantees. We will make reasonable efforts to communicate delays.

4. Refunds and cancellations

• Before production. If a sponsorship slot has not yet entered final production, you may request cancellation and a refund of the slot fee. Work already performed (such as completed creative or proofs) may be deducted as a non-refundable production cost where reasonable.
• After production starts. Once an edition has been sent to print, sponsorships are non-refundable.
• Failed editions. If an edition does not meet its minimum sponsor threshold or is otherwise canceled by us, we will refund paid sponsorships for that edition.

5. Sponsor content and license

As a sponsor, you may submit business information, logos, photos, written instructions, and other materials (collectively, “Sponsor Content”).

• Your responsibilities.You represent that you own or have the rights to use all Sponsor Content, that it is accurate, and that it does not infringe on any third party’s intellectual property, privacy, or other rights.
• License to us. You grant Hometown Coloring Book a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, and distribute Sponsor Content for the purpose of producing, printing, distributing, and promoting the coloring book edition you sponsored, including derivative coloring pages generated from your inputs.
• AI-assisted artwork. Coloring pages may be created with AI tools using your inputs and our prompts. AI-generated artwork may not be eligible for traditional copyright protection in some jurisdictions, and we make no representation that you will obtain exclusive rights in the resulting illustration. You may use the final artwork associated with your sponsorship for your own marketing and may request reasonable revisions during the proof stage.
• Content standards. Sponsor Content must be appropriate for a family-friendly publication that may reach children. We may reject or request changes to any content that we, in our sole discretion, find offensive, misleading, unsafe, unlawful, or off-brand for the edition. Categories we will not accept include adult content, tobacco, cannabis, firearms, gambling, hate speech, and content that targets children with regulated products.

6. Acceptable use

You agree not to:

• Use the Service in violation of any law or regulation.
• Upload viruses, malicious code, or content that infringes others’ rights.
• Attempt to access accounts, data, or systems you are not authorized to use, or to disrupt the Service.
• Scrape, copy, or republish the site or the coloring books without permission, except for normal personal or sponsor promotional use.
• Misrepresent your identity or your affiliation with a business.

7. Intellectual property

The Service, including the website, edition layouts, branding, and original artwork (other than Sponsor Content), is owned by Hometown Coloring Book or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.

8. Distribution and printed copies

Printed copies are distributed free to households and through partner stockists in the relevant zone. Distribution numbers, geography, and timing are estimates based on available data and may vary. We do not guarantee impressions, foot traffic, or any specific business result from a sponsorship.

9. Third-party services

The Service relies on third-party providers (such as Stripe for payments and Clerk for authentication). Your use of those services is also subject to their own terms and privacy policies. We are not responsible for third-party services or sponsor websites linked from our books or site.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any edition will achieve any particular outcome.

11. Limitation of liability

To the maximum extent permitted by law, Hometown Coloring Book and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to the Service is limited to the amount you paid us for the sponsorship or order giving rise to the claim in the twelve months before the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Hometown Coloring Book and its owners, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your Sponsor Content, your use of the Service, or your breach of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (including content licenses, disclaimers, limitations of liability, and dispute resolution) will continue to apply.

14. Governing law and disputes

These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Michigan, and you consent to personal jurisdiction in those courts. You and we each waive any right to a jury trial to the extent permitted by law.

15. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will update the “Effective” date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
